ARTICLE 8 – RIGHT OF WITHDRAWAL AND PRODUCT RETURNS

8.1 Exercising the right of withdrawal

In accordance with article L.221-28 of the French Consumer Code, the Buyer benefits from a right of withdrawal on Products purchased, except for the following Products:

• Products made to the Buyer's specifications or clearly personalized;
• Products unsealed by the Buyer after delivery and which cannot be returned for reasons of hygiene or health protection.

In accordance with article L.221-18, the Buyer has a period of fourteen (14) days from the day following receipt of the Products to exercise his right of withdrawal, without having to give reasons for his decision. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day. After this period of fourteen (14) days, the sale is firm and final. 

If the Buyer has ordered several Products in a single Order, or if the delivery has been made in several parts, the withdrawal period only begins to run when the Buyer takes possession of the last Product or the last part of the delivery.

The Buyer must notify his decision to withdraw to Customer Services, by email to contact@polene-paris.com, before the fourteen (14) day withdrawal period expires:

• by sending the withdrawal form at the end of these GTS,
• or by any other unambiguous statement clearly expressing its wish to withdraw.

The simple return of Products by the Buyer or the refusal to accept delivery, without prior notification of his decision to withdraw, is not sufficient to express the Buyer's wish to withdraw.

8.2 Returns under the right of withdrawal

In order to return a Product, the Buyer must create a customer account on the Site.

The Buyer must return the Product to the Vendor no later than fourteen (14) days following communication of his/her decision to cancel. The Buyer is advised to keep all proof of this return.

The return is free of charge for the Buyer only for deliveries in metropolitan France. In this case, the Vendor will issue a returns form to the Buyer by email, to be printed and stuck to the parcel. The postal address to which the Product must be returned is indicated on the return form provided by the Vendor.

In any event, the Buyer undertakes to return Products :

• eligible for the right of withdrawal, in accordance with article 8.1 of the GTCS,
• in their original packaging, so that the Product is protected,
• in perfect original condition, with no defects (dirt, deterioration, scratches),
• complete and accompanied by all Product accessories (e.g. second removable shoulder strap) and supplied documents (e.g. box containing the Product, pouch, booklet, instructions),
• unused, unworn,
• unsealed, if applicable,
• accompanied by the corresponding return slip.

Upon receipt, the Vendor will check whether the returned Product meets the aforementioned conditions. Failing this, the returned Product will not be reimbursed and may be returned to the Buyer, on request, subject to the latter paying the shipping costs.

8.3 Refund

If the return is validated by the Vendor, the latter will reimburse the Buyer for the price of the Product concerned :

• at the latest within fourteen (14) days from the date on which the Vendor is informed of the Buyer's decision to withdraw, provided that the Buyer has received the Product concerned within this period,
• by the same means of payment used by the Buyer to place the Order, unless the Buyer expressly agrees otherwise, and in any event at no additional cost.

The Vendor will also refund the initial delivery costs of the Product, however :

• If the Buyer has expressly chosen a more expensive delivery method than the standard one offered, these additional costs will not be reimbursed to the Buyer.
• If the Buyer decides to return part of the Products ordered, the initial delivery charges will not be reimbursed, since the amount of the delivery charges is fixed and does not depend on the number of Products ordered.

The returned Product cannot be exchanged under any circumstances. The Buyer must place a new Order.
